In Scotland, the person responsible for winding up an estate is known as the executor. The process of applying for permission to wind up an estate in Scotland is known as ‘obtaining confirmation’, not ‘probate’ as it is sometimes called.

Winding Up an Estate and Obtaining Confirmation Paisley & Glasgow
If a person dies without having a will in place (known as dying intestate), we have vast experience navigating the legal process for winding up their estate. We will draft the petition to the court to have an executor appointed. We’ll then ensure that the estate is wound up in accordance with the law.
In most cases, before an estate can be wound up, the court must ‘grant confirmation’. This allows the executor to gather the deceased’s assets – withdraw from bank accounts, realise investments and so on. Confirmation is issued by the sheriff court in the jurisdiction in which the deceased last lived. If the estate includes the deceased’s house, then a grant of confirmation must be sought so that ownership of their house can be transferred or sold.
When applying for confirmation, the executor must include an inventory of the deceased’s assets and their value. This involves contacting all of the companies (such as banks, building societies and other similar institutions) and asking them to provide details of the deceased’s accounts. After confirmation has been granted, the executor will be able to begin administering the estate – gathering in property and passing it on to the beneficiaries.
