When it’s time to submit the offer, we’ll take your instructions on what you want us to do. Once we have these, we submit a formal written offer, normally with a time limit for acceptance. When the seller’s solicitor responds to this, we’ll let you know. The usual response is a ‘qualified acceptance’ – that is to say, they are happy to accept your offer in principle but that there may have to be some negotiation about the exact terms of the transaction.
How we can help
This process of negotiation is known as the ‘missives’. The missives are simply the exchange of documents between the buyer’s and seller’s solicitors which form the legally binding contract of sale. Once missives are concluded, the seller’s solicitor will send us their final acceptance and the contract is binding!
It’s at this point that the actual ‘conveyancing’ starts! Conveyancing is a process rather than an event. It involves us liaising with the selling solicitor and completing the transfer of ownership, which must be concluded between the conclusion of missives and the date you gain access to the property, known as the date of entry.
If you are purchasing your property using a mortgage, as most people do, we will arrange for you to come in to sign the mortgage documents. It’s important that you understand what these important documents means, as failing to adhere to their conditions may see your property being repossessed by the lender.
On the date of entry, we’ll pay the purchase price to the seller’s solicitors, acquire the keys and the title deeds as well as the signed ‘disposition’, which legally transfers ownership, known in law as ‘title’, to you. Then it’s time for you to pick up your keys!

Conveyancing – Selling Property
When your property is advertised for sale, the first you’ll hear from any potential buyers is when their solicitors get in touch with us to ‘note interest’. This doesn’t necessarily bind the potential buyer into making an offer, nor does it oblige you to deal with them.
In most cases, people noting interest will submit an offer to you. We’ll advise you if the offer is suitable, based on our extensive knowledge of the local property market and the prevailing conditions at the time. You can, of course, reject, negotiate or accept any offer which is made.
Hopefully, your property will be the subject of more than one note of interest and more than one offer. In this situation, we recommend setting a closing date. Closing dates give potential buyers a deadline for making an offer on your property. We’ll advise you of these offers and provide guidance on which one is best. Obviously, in most cases, the largest offer will be the one that is accepted, however, there may be additional factors to take into consideration, which our specialist conveyancing solicitors will advise you of. If no acceptable offer is submitted, you are of course free to leave your property on the market.
In Scotland, property must be transferred using a written contract. This is formed by the various documents exchanged by us and the buyer’s solicitor. Once an acceptable offer has been received, we will issue a ‘qualified acceptance’ to the buyer and enter into missives with them. This is the process of negotiating the details of the contract.
Once the contract has been agreed, known as the conclusion of the missives, the conveyancing process begins. This involves the formal transfer of ownership of the property from the buyer and the seller, which concludes on the entry date.
As the seller of a property, you will be required to settle your existing mortgage with your mortgage lender. When your property is sold, we’ll contact your lender to obtain a figure for settlement and prepare to discharge the mortgage.
